Elizabeth Smithart has been a fixture in the community for many years having raised a family here.
Attorney Smithart has been practicing law for over 30 years and served as the City of Union Springs attorney for 11 years. Attorney Smithart’s contract with the City of Union Springs recently expired.
The city has been reviewing and discussing two contracts, one from Attorney Smithart and one from Attorney Ashley Mallory, during several recent meetings. During a Special Called Meeting Monday night, February 22, 2021, the council hired Attorney Ashley Mallory.
Attorney Smithart’s retainer fee on her contract was $750 per month plus other fees. However, a motion was made by Councilman Louis Murry to hire Attorney Ashley Mallory for $1700 per month plus other fees. Councilman Louis Pugh seconded the motion.
The motion was voted for by Councilman Louis Murry, Councilman Louis Pugh, and Councilwoman Belinda Mason Thorpe. Councilman Eugene Faulk and Councilman Derick Harris voted against the hiring of Attorney Mallory.
The mayor did not appear to cast his vote. Councilman Harris questioned Attorney Mallory’s contract regarding other fees.
Mayor Clark chose not to address the matter at the council meeting but said they could discuss it at a work session.
